Welcome to CultureOfCustoms. These Terms of Service ("Terms") govern your access to and use of our website, and your purchase of any products from us (collectively, the "Services"). By visiting our site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

## 1. Eligibility
By using our Services, you confirm that you are at least 18 years old, or that you are using the site under the supervision of a parent or legal guardian. You agree to provide accurate, current, and complete information when placing an order.
## 2. Our Products
All CultureOfCustoms products are **hand-painted, made-to-order items**. Each pair is individually painted by hand in our studio after you place your order. Because of this:
- **Slight variations are part of the product.** Brushwork, texture, and small details may vary from the product photos shown on our site. These variations are inherent to handmade artwork and are not considered defects.
- **Colors may appear differently** depending on your screen settings and lighting.
- Products are painted on **authentic, brand-new, legally purchased sneakers**.
We make every effort to display our products as accurately as possible, but we cannot guarantee that your device's display of any color or detail will be exact.
## 3. Independent Artwork Disclaimer
CultureOfCustoms is an independent art studio. **We are not affiliated with, sponsored by, endorsed by, or connected to any footwear brand or manufacturer.** All brand names and trademarks that may appear on the base sneakers belong to their respective owners.
What you are purchasing is **original, hand-painted artwork** applied to an authentic base sneaker, along with the customization service itself. The value of our products lies in the original art and craftsmanship, not in any third-party trademark.
## 4. Orders and Payment
- All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our sole discretion, including in cases of suspected fraud, pricing errors, or stock issues with the base sneaker. If we cancel your order, you will receive a full refund.
- Prices are listed in U.S. dollars and may change at any time without notice. Price changes do not affect orders already placed.
- Payment is due in full at the time of purchase and is processed securely by third-party payment processors. We do not store your full payment card details.
- You are responsible for any applicable taxes, duties, or customs fees required by your jurisdiction for international orders.
## 5. Production and Shipping Timelines
Because every pair is painted to order:
- **Production time:** typically 3–5 business days in our studio after your order is confirmed.
- **Shipping time:** up to 7 business days, depending on your location and carrier.
- **Total estimated delivery:** approximately 10–12 business days from purchase.
These timelines are estimates, not guarantees. Delays caused by carriers, customs, weather, or other events outside our control may occur, and we are not liable for such delays. We will keep you informed of your order status and provide tracking information once your order ships.
## 6. Cancellations, Returns, and Refunds
Order cancellations, returns, and refunds are governed by our **Return & Refund Policy**, which forms part of these Terms. In summary: you may cancel within 24 hours of purchase (before production begins), and you have 14 days from delivery to request a return of unworn items in original condition. Please review the full policy before ordering.
## 7. Product Care
Hand-painted artwork requires proper care. We use professional-grade materials and sealants designed for flexible surfaces, but the longevity of the artwork depends on how the product is used and maintained. Please follow our **Care Guide**. Damage resulting from machine washing, prolonged soaking, harsh chemicals, extreme conditions, or failure to follow care instructions is not covered by our Return & Refund Policy.
## 8. Intellectual Property
All content on this website — including our designs, artwork, product photography, videos, text, graphics, logos, and the CultureOfCustoms name and brand — is the property of CultureOfCustoms LLC and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from our content, or use our designs to create or sell similar products, without our prior written permission.
Purchasing a product grants you ownership of the physical item only. It does not transfer any intellectual property rights in the artwork or design.
## 9. Customer Content
If you share photos, videos, or reviews featuring our products and tag us or send them to us, you grant CultureOfCustoms a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing purposes (including on our website, social media, and advertising), with credit where reasonably possible. If you would like content featuring you removed, contact us at contact@cultureofcustoms.com and we will take it down within a reasonable time.
## 10. Prohibited Uses
You agree not to use our Services to:
- Violate any applicable law or regulation
- Infringe on our intellectual property or that of others
- Transmit malicious code, attempt to gain unauthorized access to our systems, or interfere with the operation of the site
- Submit false or misleading information, including fraudulent orders or chargebacks
- Harvest or collect personal information of others
We reserve the right to refuse service, cancel orders, or restrict access to anyone who violates these Terms.
## 11. Disclaimer of Warranties
Except as expressly stated in these Terms or our Return & Refund Policy, our products and Services are provided **"as is" and "as available"** without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the artwork will remain unchanged indefinitely; like any hand-finished product, appearance may evolve with use and time.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
## 12. Limitation of Liability
To the fullest extent permitted by law, CultureOfCustoms LLC, its owners, and its employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products, including loss of profits or data.
In any case, our total liability for any claim related to a product or order shall not exceed the amount you paid for that product.
Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.
## 13. Indemnification
You agree to indemnify and hold harmless CultureOfCustoms LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Services.
